Rahul Gandhi after his Lok Sabha suspension, I’m fighting for voice of India, says

DELHI: After a Surat court sentenced Congress leader Rahul Gandhi to two years imprisonment in a defamation case over his ‘Modi surname’ remark made in 2019, the veteran leader was suspended from Lok Sabha. On Friday evening, Rahul Gandhi finally responded to the disqualification of his MP status saying, I am fighting for the voice of India. I am ready to pay any cost. Meanwhile, opposition parties ripped into BJP for creating a political turmoil in the country. Jharkhand Chief Minister Hemant Soren Friday attacked the BJP-led government at the Centre for the disqualification of Congress leader Rahul Gandhi from the Lok Sabha and said political differences have become battles for vendetta and opposition leaders have become targets of the saffron party. He said this is ‘Aapat Kaal’ (emergency) for the nation.

“In today’s ‘Amrit Kaal’ Opposition leaders are being coerced and silenced by using every tool of power by BJP and the Centre,” Soren said in a tweet. “The disqualification of Lok Sabha membership of Shri @Rahul Gandhi Ji demonstrates how political differences have now become battles foe vendetta by the Centre. In today’s Amrit Kaal, opposition leaders are unilateral targets of the BJP. They are being coerced and silenced by using every tool of power,” said Soren in a tweet. Priyanka Gandhi targeted PM Modi in a series of tweets-‘Narendra Modi’s sycophants called a martyred Prime Minister’s son anti-national, Mir Zafar. A BJP CM even asked who is Rahul Gandhi’s father. Following the custom of Kashmiri Pandits, a son wears a turban after his father’s death, maintaining his family’s tradition.’ ‘Insulting the whole family and the Kashmiri Pandit community, you asked why they don’t keep the name Nehru in the full Parliament. But no judge gave you a sentence of two years. Did not disqualify you from the Parliament….Rahul ji like a true patriot questioned Adani’s loot…”Rahul raised questions on Nirav Modi and Mehul Choksi…. Has your friend Gautam Adani become bigger than the country’s parliament and the great people of India that you were shocked when his loot was questioned? You call my family familyist, know, this family watered India’s democracy with their blood…’‘…which you are trying to destroy. This family raised the voice of the people of India and fought for the truth from generations. The blood that runs in our veins has one specialty… Never bowed down before a coward, power-hungry dictator like you and will never bow down. Do whatever you want.

Six day old girl died in government hospital of Bargur

KRISHNAGIRI: A six-day-old female baby allegedly died of choking while being breastfed by her mother in the Bargur government hospital in the wee hours of Wednesday. Health officials, however, suspect it could be a case of female infanticide. This is the third such incident in a government hospital in the district since August last year.

According to sources, the 23- year- old woman from Bargur was admitted in the hospital on March 16 and delivered a baby girl the next day through C-section. She already has a two and a- half- year-old girl child. Around 5 am on Wednesday, relatives of the woman complained to the duty doctor that the baby was not responding after being breastfed around 4 am. Suspecting that she could have suffered aspiration, the doctor examined the baby and declared her dead.

“We suspect foul play in the death, and have informed higher officials in the health department, The body will be sent for autopsy,” an official from the hospital told TNIE. Subsequently, the baby’s father has lodged a complaint in Bargur police station. Later in the day, the body was sent to Government Krishnagiri Medical College Hospital for autopsy.

A duty doctor in the Bargur hospital said the baby was in good health when she checked her around 11 pm on Tuesday and 2 am on Wednesday. Joint Director of Health Services P Paramasivan told that action will be taken after the post-mortem report is received.

It may be recalled that in August the day-old female baby, the third child of a couple from Kelamangalam, died in similar circumstances at the Hosur government hospital. In another incident, a female baby died within 12 hours of birth at Shoolagiri UPHC in October.

Paramasivan said they are yet to receive the autopsy reports in the two cases. Deputy Director of Health Services G Ramesh Kumar said he would inquire into the deaths. Collector Deepak Jacob, who assumed office last month, was unaware of the two deaths. “The Bargur death could be a case of infant mortality. The health department will check and work against female infanticide,” he said.

  • ‘Misuse of ED, CBI against opposition’, Supreme Court to hear petition of 14 parties on April 5

‘Misuse of ED, CBI against opposition’, Supreme Court to hear petition of 14 parties on April 5

New Delhi: Fourteen political parties, including the Congress, Trinamool Congress, AAP, NCP, Shiv Sena (UBT), on Friday moved the Supreme Court against the alleged misuse of investigative agencies in arresting opposition leaders and sought guidelines on arrest.

The parties sought guidelines to fulfil and realise the guarantee of personal liberty entrenched in Article 21 of the Constitution, for all citizens, including those targeted for exercising their right to political dissent and for performing their duties as the political opposition.

The political parties forming the petitioners are: Congress, DMK, RJD, BRS, Trinamool Congress, AAP, NCP, Shiv Sena (UBT), JMM, JD(U), CPI(M), CPI, Samajwadi Party, J&K National Conference, together representing 45.19 per cent of the votes cast in the last Assembly polls, and 42.5 per cent of the votes cast in the 2019 general elections, and holding power in 11 states/union territories.

Senior advocate A.M. Singhvi mentioned the matter before a bench headed by Chief Justice D.Y. Chandrachud for early hearing.

The top court agreed to hear the matter on April 5.

The counsel clarified that they are not attempting to affect the ongoing investigations.

The plea said that 14 opposition political parties have filed a petition, in light of the alarming rise in the use of coercive criminal processes against their leaders and other citizens exercising their fundamental right to dissent and disagree with the central government.

The plea submitted that investigating agencies such as CBI and ED are being increasingly deployed in a selective and targeted manner with a view to completely crush political dissent and upend the fundamental premises of a representative democracy.

The petition has been drawn and filed by advocate Shadan Farasat and settled by Singhvi.

According to the plea, only 23 convictions under the Prevention of Money Laundering Act, 2002 (PMLA) have been secured as of now, even as the number of cases registered by the ED under the PMLA have risen exponentially (from 209 in 2013-14 F.Y. to 981 in 2020-21, and 1,180 in 2021-22).

“Between 2004-14, of the 72 political leaders investigated by the CBI, 43 (under 60 per cent) were from the Opposition of the time. Now, this same figure has risen to over 95 per cent. The same pattern is reflected in ED’s investigations as well, with the proportion of Opposition leaders from the total number of politicians investigated rising from 54 per cent (before 2014) to 95 per cent (after 2014),” it further added.

The petitioners have sought from the apex court certain prospectively applicable guidelines governing the arrest, remand, and bail of persons in offences (which may or may not be punishable with imprisonment for above seven years) not involving serious bodily harm (thereby obviously excluding homicide, rape, terrorism etc.).

“As for arrest and remand, the petitioners seek that the triple test (whether a person is a flight risk, or whether there is a reasonable apprehension of the tampering of evidence or of the influencing/intimidation of witnesses) be used by police officers/ED officials and courts alike for arrest of persons in any cognizable offences except those involving serious bodily violence. Where these conditions are not satisfied, alternatives like interrogation at fixed hours or at most house arrest be used to meet the demands of investigation.

“As for bail, the petitioners seek that the principle of ‘bail as rule, jail as exception’ be followed by all courts throughout, especially in cases where non-violent offences are alleged, and that bail be denied only where the aforementioned triple-test is met,” the plea added.

  • ‘Because he refuses to do a Savarkar..’: Rahul Gandhi gets Oppn solidarity

‘Because he refuses to do a Savarkar..’: Rahul Gandhi gets Oppn solidarity

Leaders of several opposition parties on Friday spoke up in support of Rahul Gandhi post his disqualification as a Lok Sabha MP due to his conviction in a criminal defamation case from 2019.

TMC supremo and West Bengal chief minister Mamata Banerjee called Rahul’s disqualification a ‘new low’ to India’s constitutional democracy.

“In PM Modi’s New India, Opposition leaders have become the prime target of BJP! While BJP leaders with criminal antecedents are inducted into the cabinet, Opposition leaders are disqualified for their speeches. Today, we have witnessed a new low for our constitutional democracy,” she tweeted.

BRS working president and Telangana minister KT Rama Rao called the disqualification a ‘blatant misinterpretation of Constitution’ and condemned the decision.

“Disqualification of @RahulGandhi Ji is a blatant misinterpretation of Constitution. The hastiness showed in this issue is highly undemocratic. I condemn this!” KTR tweeted.

PDP chief and Former J&K chief minister Mehbooba Mufti remarked that the Government of India is ‘clearly rattled’ by the Wayanad MP for emerging as a ‘powerful challenger’ pre-2024 elections.

“GOI is clearly rattled by RG for emerging as a powerful challenger pre-2024 elections. Since BJP can’t fight him politically, they are now subverting institutions because he refuses to do a Savarkar. The apprehensions he voiced in London are tragically being proven right,” she remarked.

CPI (M) veteran Sitaram Yechury remarked that the disqualification of Rahul Gandhi comes on top of the ‘gross misuse of ED/CBI against the opposition’.

“It’s condemnable that the BJP is now using the criminal defamation route to target opposition leaders and disqualify them as done with @RahulGandhi now. This comes on top of the gross misuse of ED/CBI against the opposition. Resist and defeat such authoritarian assaults,” he tweeted.
