    Panchayat polls: Calcutta HC seeks explanation on withdrawal of 20,585 nominations

    Kolkata: The Calcutta High Court on Friday sought an explanation from the State Election Commission (SEC) on why as many as 20,585 candidates withdrew their nominations for the July 8 panchayat elections in West Bengal.

    The division bench of Chief Justice T.S. Sivagnanam also sought to know why as many 274 seats in a particular block in South 24 Parganas district were won uncontested by the candidates of a particular party.

    The court also sought to know how Moinuddin Gazi, a Trinamool Congress candidate in North 24 Parganas district, could file his nomination despite being in Saudi Arabia.

    The division bench has asked the SEC to submit these explanations in the form of an affidavit by July 27. The matter has been listed for next hearing on June 28.

    The bench gave the directions after hearing contempt of court petitions filed by leader of opposition in West Bengal Assembly Suvendu Adhikari, and Congress MP Abu Hasem Khan Chowdhury.

    During the hearing, Additional Solicitor General Ashoke Kumar Chakrabory informed the court that the Union Home Ministry has no difficulty in deploying over 82,000 central armed forces personnel as sought by the State Election Commission.

    However, at the same time, he argued that such a huge deployment would have been more feasible had there been a five-phase poll, as happened in 2013.

    In fact, Adhikari as well as CPI(M) leader Sujan Chakraborty too had questioned whether 82,000 force personnel will be enough for the single-phase poll this time, considering that the number of voters, districts, polling stations and booths have gone up manifold since 2013.

    Bengal govt challenges Calcutta HC order in minor rape-murder case

    Kolkata (IANS) | The West Bengal government on Friday challenged the twin orders of a single bench of the Calcutta High Court in the rape and murder of a minor girl at Kaliganj in North Dinajpur district. The two orders of a single bench of Justice Rajasekhar Mantha of the High Court were upheld by Chief Justice T.S. The challenge was filed before a division bench headed by It also includes Justice Sivagnanam and Justice Hiranmoy Bhattacharya. The first order pertains to the constitution of a Special Investigation Team to probe the matter, while the second pertains to Justice Mantha seeking a report from the State Home Department on the alleged refusal of the police to cooperate with the SIT.

    Despite a petition being filed in the High Court seeking a Central Bureau of Investigation (CBI) probe into the matter, Justice Mantha constituted the SIT, comprising the then Special Commissioner of Kolkata Police Damayanti Sen, retired IG Pankaj Dutta and retired CBI Joint Director Upen Biswas was involved.

    Directed Justice Mantha and in particular the State Police to extend full cooperation to the SIT.

    However, Sen has been transferred from his current posting to the less important post of Additional Director General (Training) of the state police.

    Justice Mantha’s bench had recently received complaints against the state police for not cooperating with the SIT.

    Expressing strong objection, Justice Mantha on Thursday sought a report from the Home Department within seven days.

    The rape and murder case took place in April.

    Calcutta HC directs CBI to probe municipal recruitment scam in West Bengal based on ED’s findings

    The Calcutta High Court has directed the CBI to investigate an alleged scam in municipal recruitments in West Bengal, taking note of the Enforcement Directorate’s findings during its probe into the school jobs for bribes scam. The ED told the high court that common agents like one arrested Ayan Sil in connection with the school jobs for bribes scam were also involved in alleged illegalities in the recruitment of clerks, sweepers, peons, drivers, etc in various municipalities in West Bengal.

    “I direct CBI to carry on investigation in the Municipality Recruitment Scam also which have got common agents like Ayan Sil and common beneficiaries and the victim in both the cases (that is the Education Scam and the Municipality Recruitment Scam) is public/common people at large,” Justice Abhijit Gangopadhyay said in the order.

    In the order passed on Friday, he directed that if necessary, CBI may file one FIR for investigating the case relating to the alleged municipality recruitment scam which the court said was revealed from an application filed by ED Justice Gangopadhyay directed the DGP of West Bengal and the state’s chief secretary to instruct all departments concerned under them to help and assist the CBI and ED in their functioning while investigating the alleged scam in municipal recruitments if so requested by the central agencies.

    The court directed the CBI to file a report on April 28 to inform it of steps taken on the basis of this order. The ED filed the application stating that while investigating the money trail in the teachers’ appointment scam, it came across the alleged scam in municipal recruitments in this state.

    The ED stated that a separate FIR for investigation of the alleged municipality recruitment scam under the relevant provisions of IPC and Prevention of Corruption Act by the predicate agency (meaning thereby CBI) would be required. The ED further submitted that on account of the intermingling of the proceeds of crime of the teachers’ recruitment scam and the alleged irregularities in municipal recruitments and since CBI is investigating the school jobs for bribes scam, ED had shared detailed information with CBI with a request to investigate the latter as well.
