    Municipal Recruitment Scam: Calcutta High Court Refuses To Hear Bengal Government’s Plea

    Kolkata (IANS) | The Calcutta High Court on Friday declined to entertain a plea by the West Bengal government challenging the same court’s order for a CBI probe into the municipal recruitment case. A division bench of Justices Arijit Banerjee and Aruba Sinha Roy declined to hear the matter on the ground that it was not their subject.

    The matter has been sent back to a division bench of Chief Justice Sivagnanam and Justice Hiranmoy Bhattacharya.

    The original order for the CBI probe was given by a single bench of Justice Abhijit Gangopadhyay of the High Court. However, the state government approached the Supreme Court, which referred the matter back to the Calcutta High Court.

    The state government then approached a single-judge bench of Justice Amrita Sinha of the Calcutta High Court with a petition seeking quashing of the order for a CBI probe into the matter.

    However, Justice Sinha, on May 12, upheld the probe ordered by Justice Gangopadhyay’s bench.

    Finally, on May 16, the state government again approached the division bench of Justice Banerjee and Justice Sinha Roy, challenging Justice Sinha’s order.

    The Enforcement Directorate (ED) raids and searches at the residence of private real estate promoter Ayan Sil in connection with a recruitment ‘scam’ in government schools had unearthed irregularities in recruitment in state municipalities.

    Ram Navami violence: Bengal government challenges Calcutta High Court order in Supreme Court

    Kolkata (IANS) | The West Bengal government has approached the Supreme Court challenging the Calcutta High Court order for an NIA probe into the Ram Navami clashes in Howrah and Hooghly districts. The state government said the probe could not be handed over to a central agency as the court’s order was on a petition filed by Leader of Opposition Shubhendu Adhikari with an ulterior political motive.

    The matter will be heard on Friday.

    On April 27, a division bench of the Calcutta High Court, while ordering an NIA probe into the case, also directed the state police to hand over all documents related to the case to the central agency.

    NIA has already registered six FIRs in this case.

    The central agency had sent letters to the Additional Director General in-charge of the Criminal Investigation Department (CID) of the West Bengal Police, as well as the commissioners of the Chandranagar Police Commissionerate and Howrah City Police, seeking copies of documents related to the case.

    Ordering an NIA probe, the bench had said that it was beyond the power of the state police to find those who were responsible for the violence.

    Justice Sivagnanam also questioned the suspension of internet services in the areas.

    Internet services cannot be suspended in such clashes, he said. People get stressed due to such incidents.

    Kolkata (IANS) | The Calcutta High Court on Saturday warned the Food and Supplies Department of West Bengal of strict action if irregularities were found in the recruitment of food inspectors. A division bench of Justice Harish Tandon and Justice Prasenjit Biswas, while hearing a petition filed in this matter, said that the court will not tolerate any irregularities in the recruitment of food inspectors.

    The bench went to the extent of saying that if there was any malpractice in the recruitment process, the court would quash all the faulty appointments.

    The next hearing in the matter has been fixed for June 5.

    The written examination was conducted in 2018 to fill the vacant posts of Food Inspectors in the State Food and Supplies Department. In 2021, 100 selected candidates were given appointments.

    After the recruitments were made, some candidates who appeared for the examination approached the High Court with a petition alleging lack of transparency in the recruitment process.

    He alleged that several rules were violated in the recruitment process. Initially only 30 people were made parties in the case. On Saturday, the state government’s counsel requested the bench to implead all those involved in the case as parties in the case.

    Accepting the proposal, the bench directed the state government to complete the process before the next date of hearing.

    Kolkata (IANS) | A single-judge bench of Justice Amrita Sinha of the Calcutta High Court on Friday refused to exempt Trinamool Congress national general secretary Abhishek Banerjee from questioning by the CBI in a matter related to the letter of expelled youth leader Kuntal Ghosh from the party. In his letter, Ghosh accused central agencies of pressurizing him to name Banerjee in an alleged multi-crore recruitment scam in government schools in West Bengal.

    Originally, a bench of Justice Abhijit Gangopadhyay had allowed the CBI to interrogate Banerjee in the matter. However, following an order from the Supreme Court, two cases related to this case were transferred to Justice Sinha’s bench.

    Banerjee, a Lok Sabha member, on Thursday filed a fresh appeal before Sinha’s bench seeking relief from the CBI inquiry in the case.

    However, on Friday, Justice Sinha dismissed the plea and virtually upheld Justice Gangopadhyay’s order allowing the CBI to question Banerjee in the matter.

    Banerjee’s counsel argued that if protection from interrogation is not granted, there is every possibility that the CBI will take some coercive steps. However, refusing to accept that argument, Justice Sinha said that since the court would be open on round-the-clock basis, there would be scope to approach the court at any point of time.

    During the first hearing of the matter in his bench earlier this week, Justice Sinha had said that Banerjee should cooperate with the investigation.

    Justice Sinha told Banerjee’s counsel, “No one is above the investigation. Please cooperate with the process of investigation. What is the problem there.

    Significantly, Kuntal Ghosh had sent a letter to a local police station and a special CBI court judge, claiming that central agencies were pressurizing him to name Banerjee in the alleged recruitment scam.

    On being pointed out by the central agencies, Justice Abhijit Gangopadhyay had authorized the CBI to interrogate Banerjee in the matter.

    Banerjee had approached the Supreme Court against the order, following which the apex court had granted an interim stay on Justice Gangopadhyay’s order for a specific period, which had expired.

    Kolkata (IANS) | The Calcutta High Court on Wednesday ordered a National Investigation Agency (NIA) probe into the alleged murder of two former school students in Uttar Dinajpur district in September 2018. Justice Rajasekhar Mantha on September 20, 2018 ordered an inquiry into the murder of Tapas Barman and Rahesh Sarkar, former students of Dariwit High School in Uttar Dinajpur district, in the school premises.

    While passing the order, Justice Mantha noted that there were complaints of use of bombs, explosives and firearms in the incidents.

    He said that since the Criminal Investigation Department (CID) of the state police was not making sufficient progress in its investigation, the investigation was being handed over to the NIA.

    It may be noted that in September 2018, a group of Dariwit High School students, their parents and alumni protested against the school authorities’ decision to appoint teachers for Urdu and Sanskrit subjects, ignoring teacher vacancies for subjects such as science and maths. started protesting.

    Those opposed to the movement clashed with the protesters. Two former students of the school were killed in the firing that took place during this period.

    Justice Mantha on Wednesday said that though the postmortem report shows that Sarkar and Barman were killed by bullets, CID officials are unable to identify the nature of firearms.

    Justice Mantha also expressed displeasure over the role of the West Bengal Human Rights Commission (WBHRC), which was tasked with conducting a parallel probe in the case. He said that the conclusion of the Commission was based only on the inputs given by the District Magistrate and the District Superintendent of Police, which proved that the Commission remained inactive in the matter. He also directed the state government to give compensation to the next of kin of the deceased.

    Kolkata (IANS) | In connection with the murder of BJP leader Raju Jha, coal baron Narendra Khagra on Monday approached the Calcutta High Court, questioning the role of the police officers probing the case. In this case, the driver of Khagra was arrested on 19 April. In his petition, Khagra has claimed that his driver, Avijit Mandal, has no previous criminal record. While arresting Mandal, the police detained two more of his employees, who were later released. He also had no previous criminal record.

    Referring to the sealing of his office by the police, Khagada claimed in the petition that this was done to unnecessarily harass him because of his business relations with Raju Jha.

    The petition has been accepted and is likely to come up for hearing on Wednesday.

    Earlier this month, Raju Jha, who was waiting in front of a shop at Shaktigarh in East Burdwan district, was killed.

    He was killed just 48 hours before he was to face questioning in connection with the multi-crore coal smuggling scam in West Bengal at the Enforcement Directorate (ED) headquarters in New Delhi.

    He was also questioned in the same case by the Central Bureau of Investigation, which is conducting a parallel probe into the coal-smuggling scam.

    Kolkata: Clashes and violence over the Ram Navami procession at Rishra in Hooghly district of West Bengal on April 2 were instigated by the processionists, the state government has informed the Calcutta High Court.

    Chandernagore City Police, under whose jurisdiction Rishra comes, on Friday evening, submitted to the court a detailed report on the clashes.

    Sources aware of the contents of the report said that it mentions that those participating in the procession had been constantly “instigating” the local people by using “abusive and offensive” language constantly since the beginning of the procession.

    As per the report, although initially a section of those participating in the procession restricted themselves to using offensive language, later, some of them started pelting at the local people. Also, DJ was used in the procession without police permission and some of the participants even brandished lethal sharp weapons.

    The report has maintained that such use of such offensive language and pelting of stones instigated the locals who retaliated by resorting to counter stone-pelting. It said as police tried to restrain both sides, attacks were led against the cops and some of the police vehicles were vandalized.

    Kolkata (IANS) | A division bench of the Calcutta High Court on Wednesday directed the West Bengal government to deploy central armed forces on April 6, the auspicious occasion of Hanuman Jayanti, to avoid a repeat of the violence witnessed during Ram Navami processions.

    The violence broke out in the three districts on March 30 and continued till the night of April 3.

    Calcutta High Court Acting Chief Justice T.S. A bench of Justices Sivagnanam and Hiranmoy Bhattacharya directed the state government to identify sensitive areas in the state and take the help of central armed forces there.

    Along with this, the division also directed the state police to conduct route marches in those pockets from Wednesday night only for the purpose of area domination. Justice Sivagnanam said, looking into the matter, it is clear that the state police alone cannot manage the cases.

    The intelligence wing of the state police also faced criticism from the bench for having no prior information about a possible outbreak of violence on Ram Navami processions.

    The court said that no procession would be allowed in the area where Section 144 has been imposed amid incidents of violence in the recent past.

    The bench also suggested whether the procession on the occasion of Hanuman Jayanti can be carried out through the same areas as is done in the case of Ganesh Chaturthi procession in Maharashtra.

    The counsel for the State Government told the Court that though it would not be possible to put up barricades for all the processions in all corners of the State, the same would be done in case of sensitive areas.

    The counsel for the state government also told the court that the police will take action against the organizers of the processions who flout the restrictions imposed. The organizers will also have to inform the police about the expected crowd in the concerned procession and the organizers will also have to be present at the time limit given for the same.

    Kolkata (IANS)| A division bench of the Calcutta High Court on Monday sought a detailed report from the West Bengal government on the recent Ram Navami clashes in Howrah and Hooghly districts. Acting Chief Justice T.S. A bench of Justices Sivagnanam and Hiranmoy Bhattacharya directed the state government to submit the report along with the CCTV footage of the clashes by Wednesday.

    The action took place during the first hearing of a PIL filed by Shubhendu Adhikari, Leader of the Opposition in the state assembly. It sought a probe by the central agency into the March 30 clashes, which had turned Shibpur and Kajipara in Howrah into a battlefield.

    The bench also directed the state police to ensure that the general public is not affected due to the tension.

    Criticizing the role of the police in the matter, the bench asked the administration to be vigilant so that such incidents do not recur.

    Also on Monday, state Advocate General Soumendra Nath Mukherjee faced questions from the bench on the alleged failure on the part of the police in the case.

    Justice Sivagnanam asked why the police failed to give advance notice of such possible incidents, although similar incidents had happened in the past. How can the police have such a careless attitude? What action has been taken so far? Has section 144 been imposed in those areas?

    The advocate general of the state said that the police allowed the peaceful procession.

    After some time a section of the protesters resorted to violence, he informed the court. Section 144 has been implemented. Internet services have been suspended in some areas. So far 36 people have been arrested,

    The next hearing will be on Thursday.
