    Kejriwal did not appear in Gujarat court in defamation case, sought documents

    Ahmedabad (IANS) | Aam Aadmi Party (AAP) leaders Arvind Kejriwal and Sanjay Singh did not appear in a Gujarat court on Wednesday for the hearing of a criminal defamation case. Both the leaders will file an application seeking documents related to the case.

    The court had initially issued summons to Kejriwal and Singh on April 15 and directed them to appear before it on May 23. Thereafter, the court again issued summons, asking to appear on June 7.

    The court took this step after finding a prima facie case against him under section 500 of the IPC for criminal defamation.

    Gujarat University had filed a defamation case in April in response to Kejriwal and Singh’s statements regarding Prime Minister Narendra Modi’s degree. The metropolitan magistrate’s court had asked both the AAP leaders to appear before it on June 7.

    A defamation complaint was filed by Gujarat University Registrar Piyush Patel following comments made by AAP leaders on the Gujarat High Court verdict on PM Modi’s degree.

    The complaint alleged that the statements made by Kejriwal and Singh were derogatory and sarcastic and have damaged the reputation of the university.

    Rahul defamation case: Surat court will pronounce verdict on April 20

    Surat (IANS) | A sessions court in Surat, which is hearing Congress leader Rahul Gandhi’s appeal to stay his conviction in a criminal defamation case, has reserved its verdict. The verdict will now be pronounced on April 20. Rahul Gandhi’s lawyer has argued in the court that the loss of his Parliament membership after being convicted in a criminal defamation case over the Modi surname is a major loss.

    Senior advocate RS Cheema, representing Rahul Gandhi, claimed that the conviction on the basis of a ‘fictitious’ defamation was unfair, as only an aggrieved person can file a complaint.

    Cheema also pointed to the geographical jurisdiction of complainant Surat West BJP MLA Purnesh Modi, saying the speech was delivered in Kolar (Karnataka) and the complainant received a message on his WhatsApp in Surat.

    The senior advocate claimed that the trial court was misled, due to which Rahul Gandhi was convicted and sentenced to two years, which has been suspended till his appeal is decided by the courts.

    Meanwhile, Purnesh Modi has responded to Rahul Gandhi’s plea to stay his conviction, calling it a ‘dirty display of childish arrogance’. After hearing the arguments, Judge Robin Mogera reserved judgment in the matter. The order will now be pronounced on April 20.

    On March 25, Rahul Gandhi was suspended from the Lok Sabha after being convicted in a criminal defamation case. His constituency in Wayanad, Kerala was also declared vacant by the Lok Sabha Secretariat.

    On March 24, a Surat court found Rahul Gandhi guilty and sentenced him to two years in jail in a 2019 criminal defamation case over his remarks about Prime Minister Narendra Modi’s surname. However, the Congress leader was granted bail and his sentence was suspended for 30 days to allow him to appeal against the Surat court verdict.

    Delhi HC summons Uddhav Thackeray, Aditya, Sanjay Raut in defamation case by Shiv Sena MP

    Uddhav Thackeray, son Aaditya Thackeray and Shiv Sena (UBT) Member of Parliament Sanjay Raut were on Tuesday, March 28, issued summons by the Delhi High Court in a defamation suit filed by Shiv Sena MP Rahul Shewale, a close aide of Maharashtra Chief Minister Eknath Shinde. According to the plaintiff, Uddhav and the two others named above made frivolous allegations against Shiv Sena and its members. As per the allegations, the Thackerays and Raut said the Eknath Shinde faction bought the Shiv Sena symbol for ₹2000 crore.

    The suit filed by Shewale was heard by the Bench of Justice Prateek Jalan of the Delhi High Court. The court admitted the suit after hearing the arguments from Senior Advocate Rajiv Nayar, who appeared for the plaintiff. It also directed them to answer all material questions. The defendants were also asked to file responses to the interim applications.

    Request for an injunction order
    Shewale’s lawyer pleaded with the court to pass an injunction order which would bar Raut and others from making any further comments, which may allegedly amount to defamation. However, the court said it would wait for the responses from the parties and then pass an order.

    The matter will be heard next on April 17, 2023. The Delhi High Court also stated the shoulders of the election commission are broad enough to deal with such matters.

    Moreover, the court asked Google, Twitter, Uddhav Thackeray, Aaditya Thackeray and Sanjay Raut to file the responses within 30 days on the suit.

    Sanjay Raut had on February 19, 2023, made some remarks against the Maharashtra Chief Minister during a press conference and a case was filed by a Shiv Sena leader against Raut in Nashik in connection with the same. As per the complaint, Sanjay Raut, a Rajya Sabha MP of Shiv Sena (UBT), had alleged that a “deal of ₹ 2000 crore” had taken place to “purchase” the Shiv Sena party name and its ‘bow and arrow’ symbol.

    The statement was made days after the Election Commission of India allotted the ‘bow and arrow’ symbol to the Eknath Shinde faction and recognised it as the original Shiv Sena.
