    Excise case: Delhi court reserves order on CBI’s supplementary charge sheet against Sisodia

    New Delhi (IANS) | A Delhi court on Friday reserved its order on the Central Bureau of Investigation’s (CBI) supplementary charge sheet against former deputy chief minister Manish Sisodia and three others in the excise policy case. Besides Sisodia, the charge sheet also names Arjun Pandey, Buchi Babu Gorantla and Amandeep Dhal.

    Special Judge M.K. Nagpal listed it for pronouncement of order on May 27.

    More details are awaited.

    The CBI, in its supplementary charge sheet, has alleged that Sisodia had procured some emails of his own accord through Delhi Minorities Commission (DMC) chairman Zakir Khan to manipulate the process of seeking comments/suggestions regarding the liquor policy.

    The probe agency has claimed that Sisodia was not happy with the recommendations of the expert committee report submitted by former Excise Commissioner Ravi Dhawan on October 13, 2020 and has asked new Excise Commissioner Rahul Singh to initiate the Excise Department to invite comments from the general public and stakeholders. Instructed to put the report on the portal.

    The CBI has alleged that Sisodia destroyed the draft cabinet note prepared by the Excise Department which was placed before the Council of Ministers in its meeting held on January 28, 2021.

    In the draft cabinet note, former Chief Justices of India Ranjan Gogoi and K.G. Besides Balakrishnan, legal opinion of former Attorney General and senior advocate Mukul Rohatgi and others was also incorporated.

    NEW DELHI: Delhi’s Rouse Avenue Court on Friday extended former Delhi Deputy CM Manish Sisodia’s judicial custody till June 2 in the CBI case on excise policy.

    Consideration of the charge sheet pending before the court.

    Sisodia was arrested by CBI and ED in an ongoing investigation of a case related to alleged irregularities in the framing and implementation of the excise policy of the Government of the National Capital Territory of Delhi.

    According to the CBI, Sisodia had played the most important and vital role in the criminal conspiracy and had been deeply involved in the formulation and implementation of the said policy to ensure the achievement of the objectives of the said conspiracy.

    Delhi Court Extends Former Delhi’s Former Deputy CM Manish Sisodia’s Judicial Custody Till May 23

    A Delhi court on Monday extended till May 23 the judicial custody of former deputy chief minister Manish Sisodia in a money laundering case related to the alleged excise scam. Special Judge M K Nagpal extended the custody of the AAP leader after he was produced before the court on expiry of his judicial custody granted earlier.

    The court noted the submission of the Enforcement Directorate’s Special Public Prosecutor N K Matta, who submitted that the agency has filed a supplementary charge sheet against the accused, which is scheduled for consideration on May 10. The court had earlier dismissed Sisodia’s bail plea, saying “the case of economic offences has serious repercussions upon the general public and society at large as the evidence collected during investigation speaks volumes of his involvement in the commission of the said offence”.

    The ED on March 9 arrested Sisodia in the liquor policy case. Sisodia was arrested by the CBI earlier in its ongoing investigation of a case related to alleged irregularities in the framing and implementation of the Delhi Excise Policy 2021-22. He is currently in judicial custody in both cases.

    New Delhi (IANS) | A Delhi court has fixed May 12 for hearing the bail application of businessman Amandeep Singh Dhall in the Excise Policy case. Rouse Avenue Court’s Special CBI Judge M.K. Nagpal gave a date for hearing on Dhal’s plea on a joint request by the Enforcement Directorate (ED) and the accused.
    Special Public Prosecutor N.K. Matta sought an adjournment saying the court has summoned Dhal and other co-accused on May 12 after the ED filed a supplementary prosecution complaint (equivalent to a chargesheet in the ED’s process) against them.
    Further, Dhall’s counsel sought adjournment to address arguments on his bail application.
    Therefore, the petition on the joint request is directed to be listed on May 12 for arguments, the judge said.
    The court had last Saturday extended the custody of former Delhi Deputy Chief Minister Manish Sisodia till May 8 in the excise policy matter being probed by the ED.
    The same court had on April 27 extended Sisodia’s judicial custody till May 12 in the case being probed by the Central Bureau of Investigation (CBI).

    Delhi court extends Anubrata Mondal’s judicial custody till May 4

    NEW DELHI: The Delhi Court on Monday extended the judicial custody of Trinamool Congress (TMC) leader Anubrata Mondal till May 4 in connection with the cattle smuggling case. Meanwhile, the arguments on his application seeking his transfer from Delhi to Asansol Correctional Home (West Bengal) are underway.

    In March, the TMC’s Birbhum district president moved an application in Delhi’s Rouse Avenue Court seeking his transfer to Asansol Correctional Home (West Bengal).

    Earlier, on Monday, the TMC leader was produced in Delhi’s Rouse Avenue Court at the expiry of his judicial custody.

    Earlier, on April 27, the Rouse Avenue Court granted three days’ custody of Sukanya Mondal, Anubrata’s daughter, to Enforcement Directorate (ED) to interrogate her in the cattle smuggling case. She was arrested on the previous day by the ED.

    Special judge Raghubeer Singh granted three days’ custody after hearing the submission of the special public prosecutor (SPP) Nitesh Rana and defence counsels.

    The court, however, allowed the counsels to meet the accused during ED custody. It also directed the ED to get the accused medically examined in every 48 hours.

    ED sought three days’ remand to trace the proceeds of the crime, trace the money trail and identify the modus operandi. She was also to be sat along her father and TMC strongman Anubarata and questioned in connection with the case. The SPP submitted that Sukanya Mondal was arrested on April 26 evening.

    A close aide of West Bengal Chief Minister Mamata Banerjee, Anubrata was arrested by the CBI in connection with the cattle smuggling case in July last year.

    Mehrauli murder case: Delhi court to pass order on framing of charges on Saturday

    New Delhi (IANS) | A Delhi court is likely to pronounce its order on Saturday on framing of charges against Aftab Amin Poonawala, accused of strangling his live-in partner Shraddha Walker to death and then dismembering her body in Mehrauli area of the capital. Additional Sessions Judge Manisha Khurana Kakkar posted it for hearing on April 29 after reserving orders on framing of charges on April 15.

    Besides this, the Delhi Police is also about to file its reply on the application of Vikas Walker (Shraddha’s father) seeking the release of his daughter’s mortal remains to perform the last rites. Special Public Prosecutor Amit Prasad had said during the last hearing that the police would file a reply to the application on the next date of hearing.

    Last time the debate on the charges was also completed. The Delhi Police had earlier told the court that the aggravating circumstances are clearly brought out by credible and cogent evidence and they constitute a chain of events.

    Poonawalla has been booked under IPC sections 302 (murder) and 201 (causing destruction of evidence of offence). A charge sheet running into over 6,000 pages was filed in the case.

    Excise policy scam: Delhi court defers decision on Sisodia’s bail plea in ED case

    New Delhi (IANS) | A Delhi court on Wednesday deferred its order on the bail plea of AAP leader and former deputy chief minister Manish Sisodia in the Delhi Excise Policy case being probed by the Enforcement Directorate (ED). Rouse Avenue Court’s Special Judge M.K. Nagpal will now pronounce the verdict on April 28. He had on April 18 reserved judgment on Sisodia’s bail plea.

    The court had a day earlier extended Sisodia’s judicial custody in the case by two weeks. The ED had earlier submitted before the judge that Sisodia had shown fabricated emails to show that there was public acceptance for the policy.

    The ED claimed that instructions to send these pre-draft emails were given to Delhi Minorities Commission chairman Zakir Khan, who asked his interns to send the emails. The probe agency had also said that the 60 days given to complete the probe against Sisodia have not yet expired.

    It said it has found fresh evidence indicating Sisodia’s involvement in the alleged scam and the investigation is at a critical stage.

    Delhi court convicts father-son duo in 2020 riots case

    New Delhi: A court here has convicted a father-son duo for rioting and arson in a case of the 2020 North East Delhi riots, saying the prosecution proved the charges against them beyond a reasonable doubt.

    The case against Mithhan Singh and his son Jony Kumar was being heard by Additional Sessions Judge (ASJ) Pulastya Pramachala.

    The duo was accused of being part of a riotous mob that set many properties on fire in lane number 4 in Khajuri Khas on February 25, 2020.

    “I find that it is proved beyond doubt against both the accused that they were part of the mob which burnt the property (of complainant Shabana Khatoon). Thus, they are held guilty of the offences under sections 147 (rioting) 148 (rioting, armed with a deadly weapon) 436 (mischief by fire or explosive substance with intent to destroy house, etc) read with section 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object) of the Indian Penal Code and convicted accordingly,” the judge said.

    New Delhi (IANS) | A Delhi court on Saturday reserved its order on framing of charges against Aftab Amin Poonawalla, accused of strangling live-in partner Shraddha Walker to death and then dismembering her body in Mehrauli area. Arguments on the charges were completed on Saturday. After this, Additional Sessions Judge Manisha Khurana Kakkar adjourned the hearing of the case till April 29.

    Meanwhile, Vikas Walker filed an application in the court, seeking to hand over his daughter’s mortal remains to him for performing the last rites. Special Public Prosecutor Amit Prasad said that the police would file a reply to the application on the next date of hearing.

    The Delhi Police had earlier told the court that the incriminating circumstances are clear from reliable and cogent evidence and they establish a chain of events.

    Poonawalla has been booked under IPC sections 302 (murder) and 201 (causing destruction of evidence of offence).

    New Delhi: Counsel of Aaftab Amin Poonawala, who is accused of strangling his live-in partner Shraddha Walkar to death, chopping her body into several pieces, storing them in a fridge before disposing of them in a forest over three months, on Friday complained in court that his client was “manhandled” during his production in court.

    As Additional Sessions Judge Manisha Khurana Kakkar heard the arguments on charges against the accused, she also directed the authorities concerned to ensure the safety of Poonawala.

    “Lock-up in charge, Saket Court, as well as jail superintendent, are directed to ensure that the accused is produced safely during court productions,” she said.
