    Gujarat HC judge recuses from hearing Morbi bridge collapse accused’s bail plea

    Ahmedabad: Gujarat High Court judge Samir Dave on Thursday recused himself from hearing the regular bail plea of a manager of the Oreva Group who is in jail for his alleged role in the last year’s Morbi bridge collapse in which 135 people were killed.

    When manager Dinesh Dave’s bail plea came up for hearing before Justice Samir Dave, he recused himself, saying “not before me,” but didn’t assign any reason for the decision.

    Dinesh Dave is one of the ten accused arrested by police after a British-era suspension bridge collapsed in October last year in Morbi town of Gujarat.

    As many as 135 people were killed and 56 grievously injured when the bridge, maintained and operated by Oreva Group, collapsed days after it had been reopened following repairs.

    Notably, Justice Dave recently granted regular bail to five accused in the case — two booking clerks and three security guards — who were deployed on the bridge by the company.

    Those who are still behind bars in the case include Jaysukh Patel, managing director of the Oreva Group; managers of the firm Dipak Parekh and Dinesh Dave; sub-contractors Prakash Parmar and Devang Parmar, who had been hired by the company for carrying out repair works on the more than 100 years old structure.

    The suspension bridge over the Machchhu river in Morbi town was a popular tourist attraction and it collapsed on October 30 when more than 200 people were on it.

    The Morbi police had in January filed a chargesheet in the case.

    All the ten accused have been charged under Indian Penal Code section 304 (culpable homicide not amounting to murder) besides for other offences.

    Congress leader Rahul Gandhi faced another setback as the Gujarat High Court declined his plea for an interim stay on his conviction in a criminal defamation case over his “Modi surname” remark.

    The Surat court had sentenced him to two years in jail. The High Court’s verdict on his petition will be delivered after the summer vacation, on June 4. Gandhi had appealed for an interim stay on his conviction until the High Court’s final verdict.

    As a result of the Surat court’s decision, Rahul Gandhi was disqualified from his position as a Member of Parliament.

    During an earlier hearing on April 29, Gandhi’s lawyer argued that a maximum punishment of two years for a bailable, non-cognisable offence could result in the permanent and irreversible loss of his Lok Sabha seat. This was a serious additional consequence that would affect both Gandhi and the people he represents. The alleged offence was not serious in nature and did not involve moral turpitude, yet his disqualification due to the failure to stay his conviction would have severe implications.

    The Gujarat High Court on Friday said in a judgment that there is no need for the Prime Minister’s Office to announce the graduation and post-graduation degrees of Prime Minister Modi. Not only this, the High Court also imposed a fine of Rs 25,000 on the petition filed by Delhi Chief Minister Arvind Kejriwal, calling it frivolous and misleading. Kejriwal had asked for the details of PM Modi’s degree certificate.

    Instructions given to CM Kejriwal

    CM Kejriwal has now been directed to deposit the amount of this fine in the State Legal Services Department of Gujarat State. Significantly, the CIC of India had issued an order directing the Public Information Officer (PIO) of the PMO and the PIOs of Gujarat University and Delhi University to disclose the details of PM Modi’s undergraduate and postgraduate degrees. Now the Single Bench of Justice Biren Vaishnav in the Gujarat High Court has set aside the CIC order.
